As published in the Financial Industry Regulatory Authority (FINRA) disciplinary actions report for April 2012, Richard Joseph Buswell of Lafayette, Louisiana and Herbert Steven Fouke of Lafayette, Louisiana were barred from association with any FINRA member in any capacity. The sanctions were based on findings that Buswell and Fouke made numerous misrepresentations and omissions of material fact to customers who purchased unsecured bridge notes, warrants and unsecured promissory notes issued by a company that failed to repay holders ofthese units, failed to exchange their warrants for common stock and filed for Chapter 11 bankruptcy protection.

On April 20, 2012 U.S. Securities and Exchange Commission (SEC) published that the comission charged twin brothers from the U.K. with defrauding approximately 75,000 investors through an Internet-based pump-and-dump scheme in which they touted a fake ?stock picking robot? that purportedly identified penny stocks set to double in price. Instead, the brothers were merely touting stocks they were being paid separately to promote. The SEC alleges that Alexander John Hunter and Thomas Edward Hunter were just 16 years old when they set their fraud in motion beginning in 2007. They disseminated e-mail newsletters through a pair of websites they created to tout stocks selected by the robot ? which they described as a highly sophisticated computer trading program that was the product of extensive research and development.

Cantone of Thompson, Pennsylvania has submitted an Offer of Settlement in which the firm was censured, fined $25,000, $10,000 of which was jointly and severally with Christine Cantone, and ordered to pay a total amount of $200,000 in partial restitution to customers, jointly and severally with Christine Cantone. Christine Cantone was suspended from association with any FINRA member in any principal capacity for three months.

Janson was also suspended from association with any FINRA member in a General Securities Principal (Series 24) capacity for one year. Laraway was also suspended from association with any FINRA member in an Operations Professional (Series 99) capacity for one year and Seefried was suspended from association with any FINRA member in any General Securities Principal (Series 24) capacity for one month.

As published in the Financial Industry Regulatory Authority (FINRA) disciplinary actions report for April 2012, Success Trade Securities, Inc. of Washington, DC and Fuad Ahmed Washington, DC has submitted a Letter of Acceptance, Waiver and Consent in which the firm was censured and fined $100,000. Ahmed was fined $10,000, suspended from association with any FINRA member in any principal capacity for 60 days, and must complete 16 hours of continuing education related to AML compliance in a program acceptable to FINRA. The training must be completed within six months after the issuance of this AWC. Within 30 days following completion of the training, Ahmed must provide FINRA with written proof of completion.

On April 18, 2012 U.S. Securities and Exchange Commission (SEC) published that the final judgments have been entered in the United States District Court in Phoenix, Arizona against three former officers and managers of Phoenix-based CSK Auto Corporation (CSK). The Commission?s complaint, filed in 2009, alleged that from 2002 to 2004, Don W. Watson, CSK?s former chief financial officer, senior vice president, and treasurer, Edward W. O?Brien, CSK?s former controller, and Gary M. Opper, CSK?s former director of credit and receivables, engaged in a scheme to materially overstate CSK?s income by aggressively recognizing vendor allowances and failing to write off vendor allowance receivables when management knew the receivables were uncollectible. Because of the scheme, CSK filed false financial statements overstating pre-tax income for fiscal year 2002 by 48.6%, or $11.2 million, fiscal year 2003 by at least $37.4 million, thereby reporting pre-tax income instead of a pre-tax loss, and fiscal year 2004 by at least 67.2%, or $21.4 million. At the time of the fraud, CSK was one of the nation?s largest auto parts retailers with over 1000 stores located throughout the western United States. In July 2008, CSK became a wholly owned subsidiary of O?Reilly Automotive, Inc.

On April 17, 2012 U.S. Securities and Exchange Commission (SEC) published that the commission deems it appropriate and in the public interest that public administrative proceedings be, and hereby are, instituted pursuant to Section 15(b) of the Securities Exchange Act of 1934 against Timothy T. Page (?Respondent? or ?Page?). After an investigation, the Division of Enforcement alleges that: Respondent Page, age 62, is a citizen of Great Britain who emigrated to the United Sates and later resided in Austin, Texas during 2004. In 2005, he moved to Malibu, California. Page was the general partner of Page Properties LP, a limited partnership formed in Texas in 2000.

Cherry (Cherry) was enjoined from future violations of the securities statutes in SEC v. Aubrey, 8:11-cv-01564-JVS-RNB (C.D. Cal. Feb. 3, 2012).
